Aysel Tuğluk
Aysel Tuğluk soll im „Kobanê-Prozess“ in Ankara zwangsweise vorgeführt und angehört werden. Die kurdische Politikerin und Rechtsanwältin ist im Gefängnis an Demenz erkrankt und nicht mehr in der Lage, zusammenhängende Sätze zu formulieren.
In Ankara ist der sogenannte Kobanê-Prozess fortgesetzt worden. In dem im April 2021 eröffneten Prozess werden 108 Angeklagte, darunter der ehemalige Vorstand der Demokratischen Partei der Völker (HDP), im Zusammenhang mit den Protesten während des IS-Angriffs auf Kobanê im Oktober 2014 terroristischer Straftaten und des Mordes in dutzenden Fällen beschuldigt. Von den 108 Beschuldigten befinden sich 21 Politikerinnen und Politiker in Haft, so auch die schwer an Demenz erkrankte Aysel Tuğluk. Die Verhandlungen finden im Gefängniskomplex Sincan statt, das gesamte Verfahren ist ein politischer Schauprozess zur Eliminierung der HDP.
Aysel Tuğluks Verteidiger Serdar Çelebi beantragte in der heutigen Verhandlung, auf die Anhörung seiner Mandantin zu verzichten. „Aysel Tuğluk ist nicht in der Lage, sich zu verteidigen. Ihr Gesundheitszustand ist bekannt“, erklärte der Rechtsanwalt, der aus Amed (tr. Diyarbakir) über das Videosystem SEGBIS im Gerichtssaal zugeschaltet wurde. Der vorsitzende Richter schnitt ihm das Wort ab und wies auf ein Gutachten des gerichtsmedizinischen Instituts ATK zur Haftfähigkeit der kurdischen Politikerin hin. Çelebi argumentierte, dass seine Mandantin aufgrund ihrer Erkrankung keine zusammenhängende Sätze formulieren und sich keinesfalls verteidigen könne. Das Gericht wies alle Einwände zurück und ordnete die Vorführung der Angeklagten Anfang kommender Woche an.
Aysel Tuğluk befindet sich seit Ende 2016 unter Terrorvorwürfen im Hochsicherheitsgefängnis Kandıra in der Schwarzmeerprovinz Kocaeli in Haft. Im vergangenen Jahr stellte ein von neun Fachleuten erstelltes Gutachten der forensischen Abteilung der Universität Kocaeli fest, dass die 56-Jährige aufgrund einer chronischen und fortschreitenden Alzheimer-Demenz nicht länger haftfähig ist und sofort aus dem Gefängnis zu entlassen sei. Das Istanbuler ATK, eine Einrichtung des Justizministeriums, hat eine gegenteilige Feststellung getroffen und sah bisher keinen Grund für eine Aussetzung des Strafvollzugs.
Aysel Tuğluk war vor ihrer politischen Laufbahn selbst Rechtsanwältin und hat unter anderem Abdullah Öcalan verteidigt. Bis zu ihrer Verhaftung Ende 2016 war sie stellvertretende Vorsitzende der Demokratischen Partei der Völker (HDP). In mehreren Verfahren wurde sie bereits verurteilt, andere Prozesse sind noch anhängig. Im Februar 2020 bestätigte der türkische Berufungsgerichtshof die bislang höchste Freiheitsstrafe gegen Tuğluk mit über zehn Jahre Haft. Verurteilt wurde sie aufgrund ihrer Funktion als Ko-Vorsitzende des „Demokratischen Gesellschaftskongresses” (KCD) wegen „Leitung einer Terrororganisation“. Im Oktober vergangenen Jahres verhängte ein Gericht in Wan eine zwanzigmonatige Freiheitsstrafe wegen angeblicher PKK-Propaganda in den Jahren 2012 und 2013. Im sogenannten Kobanê-Prozess in Ankara droht Aysel Tuğluk eine erschwerte lebenslange Freiheitsstrafe.[1]
