inhaftierte IS-Mitglieder
In der Autonomieregion Nord- und Ostsyrien laufen die Vorbereitungen für Gerichtsprozesse gegen Tausende inhaftierte #IS# -Mitglieder aus sechzig verschiedenen Ländern. Unter den IS-Gefangenen befinden sich auch deutsche Staatsangehörige.
Die Autonomieverwaltung von Nord- und Ostsyrien (AANES) hat am 10. Juni angekündigt, ausländische IS-Mitglieder vor lokale Gerichte zu stellen. Vorangegangen waren jahrelange Appelle an die Herkunftsstaaten, einen internationalen Gerichtshof für die Ahndung der vom „Islamischen Staat“ begangenen Verbrechen einzurichten. Weil darauf keine Antwort erfolgte und die AANES mit Tausenden IS-Gefangenen aus etwa sechzig verschiedenen Ländern allein gelassen wird, soll jetzt eine juristische Aufarbeitung vor Ort erfolgen.

Die Vorbereitungen auf die Prozesse laufen, aber nach wie vor sind viele Fragen offen. Wie die Nachrichtenagentur ANHA unter Berufung auf Quellen der AANES berichtet, sollen die Gerichtsverhandlungen innerhalb kurzer Zeit beginnen. Der genaue Zeitpunkt und die Verhandlungsorte sind nicht bekannt, werden jedoch vermutlich in den kommenden Tagen veröffentlicht. Den Angaben zufolge sollen die Verfahren öffentlich verhandelt werden, vor Volksgerichten, die dem Rat für gesellschaftliche Gerechtigkeit angegliedert sind. Vermutlich werden Angehörige von IS-Opfern als Nebenkläger:innen zugelassen, aber auch zu dieser Frage gibt es noch keine offizielle Erklärung. Ebenso ist unklar, ob eine Prozessbeobachtung aus dem Ausland zugelassen wird. Laut ANHA hat die Autonomieverwaltung jedoch ein Interesse daran, ihr Justizsystem weltweit vorzustellen.

In Nordostsyrien gibt es keine Todesstrafe. Die AANES steht vor der Herausforderung, ihre eigenen Gesetze mit internationalem Recht im Antiterrorkampf zu verbinden. Diskutiert wird auch über die Frage, ob die Angeklagten eine anwaltliche Verteidigung haben werden und was mit den Verurteilten nach Vollendung ihrer Haftstrafe geschehen soll.

Auch Deutsche werden angeklagt
Unter den IS-Gefangenen in Nordostsyrien befinden sich auch deutsche Staatsangehörige. Aus den Internierungslagern sind in Absprache mit der AANES bisher 27 Frauen, 80 Kinder und ein Heranwachsender nach Deutschland zurückgeführt worden. Einige der Frauen wurden vor deutschen Gerichten wegen Mitgliedschaft und Verbrechen im Zusammenhang mit dem IS verurteilt.

Die Linksabgeordnete Gökay Akbulut will in der kommenden Woche im Bundestag nachfragen, wie sich die Bundesregierung bisher zur Einrichtung eines internationalen Tribunals für IS-Verbrechen in Nordostsyrien positioniert hat, ob sie sich an den Kosten der Inhaftierung von mutmaßlichen IS-Mitgliedern beteiligt und inwieweit beabsichtigt wird, die juristische Aufarbeitung der IS-Verbrechen in der Autonomieregion zu unterstützen. Eine weitere Frage betrifft die konsularische Betreuung deutscher IS-Mitglieder in nordostsyrischen Gefängnissen. Die Fragestunde im Bundestag findet am 21. Juni statt.[1]
